Terms of Use

These Terms of Use (“Terms”) govern your access to and use of the True Vitamin websites, apps, and related services (the “Service”). By using the Service, you agree to these Terms.
1. Who we are
The Service is operated by TrueVitamin Inc. (operating as “True Vitamin”), a company based in Québec, Canada (“True Vitamin,” “we,” “us,” “our”).
2. Eligibility
You must be at least 18 (or the age of majority where you live) to use the Service. By using the Service, you represent you meet this requirement.
3. Your account
You are responsible for:
- maintaining the confidentiality of your login credentials,
- all activity under your account,
- ensuring information you provide is accurate and up to date.
We may suspend or terminate accounts for suspected misuse, fraud, or security risk.
4. What the Service does (and does not do)
A. Informational + convenience service only
True Vitamin provides tools that may generate nutrition and supplement suggestions using software (including AI) and, in some cases, optional human review. The Service is provided for informational and convenience purposes only.
B. Not medical advice; no clinician relationship
True Vitamin is not a medical device, hospital, clinic, or emergency service. We do not provide medical diagnoses or treatment. Nothing in the Service creates a doctor-patient, dietitian-patient, or other professional relationship.
Always seek advice from a qualified healthcare professional regarding any medical condition, medication, pregnancy, allergies, supplement interactions, or health decisions.
C. Emergencies
If you think you may have a medical emergency, call emergency services immediately.
5. AI outputs and limitations
The Service may generate outputs that are probabilistic and may be incomplete, incorrect, or not appropriate for your situation. You are solely responsible for how you use outputs and for verifying decisions with qualified professionals.
6. Data you provide; cross-border processing
You understand that:
- you may provide sensitive information, including health-related data,
- the Service is hosted and processes data in the United States,
- by using the Service, you consent to cross-border transfer and processing as described in the Privacy Policy.
7. Expert reviews (if offered)
If the Service offers optional “expert review,” it is:
- on-demand (not automatically performed for every plan unless explicitly stated), and
- limited to review of information you provide in the Service context.
Expert review does not replace medical care and does not guarantee outcomes.
8. Supplements, products, and commerce
A. Product information
Product descriptions, educational content, and recommendations are provided for convenience and may not be complete or current. Manufacturers are responsible for product labeling.
B. Not responsible for manufacturers; no guarantees
To the maximum extent permitted by law, True Vitamin is not liable for issues caused by manufacturers, suppliers, shipping carriers, or product defects. Your remedies (if any) may lie with the manufacturer or applicable warranty/return policies.
C. Regulatory disclaimers (U.S.)
Certain supplement statements may require the DSHEA disclaimer on labels/marketing under U.S. rules. We do not guarantee that any product will achieve any health outcome.
9. Orders, subscriptions, billing
If you purchase subscriptions or products:
- you authorize us (and our payment processors) to charge your selected payment method, including recurring charges for subscriptions/auto-renewals where applicable,
- prices, taxes, shipping, and renewal terms will be disclosed at checkout or plan selection,
- cancellation and refund rules are described at purchase time and/or in the applicable policy.
We may refuse, cancel, or limit orders where permitted (e.g., suspected fraud, pricing errors, inventory issues).
10. Acceptable use
You agree not to:
- misuse the Service (reverse engineer, interfere, probe security, scrape at scale),
- upload malicious code,
- use the Service to violate laws or others’ rights,
- submit false, misleading, or infringing content,
- use the Service for high-risk decisions where errors could cause harm (unless you independently validate with professionals).
11. Third-party services
The Service may integrate with third-party platforms (wearables, labs, payment processors, commerce platforms). We do not control third parties and are not responsible for their services, data practices, downtime, or errors. Your use of third-party services is governed by their terms.
12. Intellectual property
The Service, including software, design, trademarks, and content, is owned by True Vitamin or licensors and protected by applicable IP laws. You receive a limited, revocable, non-transferable license to use the Service for personal, lawful purposes.
13. Your content
You retain ownership of content you submit, but you grant True Vitamin a worldwide, royalty-free license to host, use, reproduce, process, and display it to operate, improve, and secure the Service, and as otherwise described in the Privacy Policy.
14. Disclaimers
The Service is provided “as is” and “as available.” To the maximum extent permitted by law, we disclaim all warranties, express or implied, including fitness for a particular purpose, merchantability, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that outputs will be accurate or suitable for you.
15. Limitation of liability
To the maximum extent permitted by law:
- True Vitamin will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits/revenue, lost data, or business interruption.
- True Vitamin’s total liability for any claim relating to the Service or products will not exceed the greater of (a) the amount you paid to True Vitamin in the 12 months before the event giving rise to the claim or (b) USD $100 (or CAD equivalent).
Québec carve-outs
Nothing in these Terms limits liability where such limitation is prohibited under Québec law (including limits relating to bodily or moral injury, and intentional/gross fault).
16. Indemnification
You agree to indemnify and hold harmless True Vitamin and its directors, officers, employees, and contractors from claims arising out of your misuse of the Service, your content, or your violation of these Terms or applicable law.
17. Dispute resolution; governing law; venue
A. Governing law
These Terms are governed by the laws of Québec and the federal laws of Canada applicable therein, without regard to conflict-of-laws principles, except where your local consumer law provides non-waivable rights.
B. Venue
Except where prohibited by law, you agree that disputes will be brought in the courts located in Montréal, Québec.
C. Arbitration / class actions (important)
Some jurisdictions (including Québec consumer contracts) restrict mandatory arbitration and class action waivers. Accordingly, any arbitration or class-action waiver language applies only to the extent permitted by applicable law and does not apply where prohibited.
18. Changes to these Terms
We may update these Terms. If changes are material, we will provide notice as required. Continued use after the effective date means you accept the updated Terms.
